END USER LICENSE AGREEMENT (Terms of Service)

 

PLEASE CAREFULLY READ THIS END USER LICENSE AGREEMENT (EULA) PRIOR TO PURCHASING OR USING SERVICES PROVIDED BY Revcode (HEREINAFTER – SERVICES/LICENSED SOFTWARE). BY PURCHASING OR USING OUR SERVICES, YOU AGREE TO ADHERE TO THE TERMS OF THIS EULA. IF YOU DO NOT ACCEPT THE TERMS, DO NOT INSTALL OR USE ANY OF OUR SERVICES. THIS EULA IS A LEGAL AGREEMENT BETWEEN YOU (HEREINAFTER – THE USER) AND Revcode (HEREINAFTER – THE SERVICE PROVIDER/Revcode) FOR USE OF THE SOFTWARE. BY DOWNLOADING, INSTALLING, OR OTHERWISE USING ANY OF OUR SERVICES OR SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA. IF YOU DO NOT AGREE TO THE TERMS OF THIS EULA, YOU MAY NOT DOWNLOAD, INSTALL, OR USE ANY SERVICE OR SOFTWARE PROVIDED BY Revcode.

BY ACCEPTING THIS EULA, YOU AGREE TO USE SERVICES PROVIDED BY Revcode, AND/OR INSTALL SOFTWARE PROVIDED BY Revcode ONLY ON DEVICES OWNED BY YOU, AND FOR CLOUD-BASED OR OTHER MONITORING THAT DOES NOT REQUIRE INSTALLATION ON A DEVICE, TO USE IT ONLY IN CONNECTION WITH AN ACCOUNT, APPLICATION, OR PROGRAM YOU HAVE THE LEGAL RIGHT TO ACCESS. YOU ALSO AGREE TO INFORM ANY PERSON(S), WHO USE(S) A DEVICE WITH THE SOFTWARE INSTALLED AND ANY OTHER PERSON WITH THE RIGHT TO ACCESS A MONITORED ACCOUNT OF THE PRESENCE OF THE SOFTWARE. FAILURE TO COMPLY HEREWITH MAY RESULT IN VIOLATING APPLICABLE LAW BY YOU. YOU UNDERSTAND AND AGREE THAT YOU SHALL BE RESPONSIBLE FOR ANY LEGAL COSTS INCURRED BY ANY OF THE SERVICES PROVIDED BY Revcode, AND/OR BY ANY PERSON(S), WHO USE(S) A DEVICE WITH THE SERVICE(S) INSTALLED RESULTING FROM YOUR IMPROPER OR ILLEGAL USE OF THE SOFTWARE.

All services provided by Revcode with capabilities of remote surveillance are designed and intended for parental control, monitoring of your employees and educational purposes only. It is the violation of laws, almost worldwide, to install surveillance software, such as certain services provided by Revcode onto any device you do not have the right to access. The law generally requires you to notify the owner of a device that it is being monitored. The violation of this requirement could result in severe monetary and criminal penalties imposed on the violator. You should consult with a legal adviser with respect to the law regarding the services provided by Revcode in the manner you intend to use it prior to purchasing, downloading, installing, and/or using it. You take full responsibility for determining that you have the right to monitor a device on which services provided by Revcode are installed. Revcode shall not be held responsible if you choose to monitor a device without being entitled to; nor can Revcode provide legal advice regarding the use of the offered services.

Services provided by Revcode and any other products offered by Revcode, not sold, to you for use only under the terms of this license. Revcode as the Service Provider reserves all rights not expressly granted to you.

Cryptography Notice

All Revcode WebMonitor services include cryptographic software. Your country may have restrictions on the possession, import, use, and/or re-export to another country, of software using cryptography. Please check your country’s laws, regulations and policies concerning the import, possession, or use, and re-export of encryption software before using any service offered by Revcode to see if it is permitted.   1. End User acknowledges that services provided by Revcode shall be used for the purpose of lawful monitoring, tracking and obtaining access to certain devices as computer and cell phone (including, but not limited to, email and text messages) of children, employees and other device owners with their consent hereto, including through the use of devices, on which the services are installed.
  2. End User understands that the Revcode team may at any time temporarily lock your service(s) following random security checks.
    This may also automatically happen immediately upon the completion of your order should our system detect potential issues with your order.
    In such event, you may be asked to declare your intended use of the purchased service(s). You may also be asked to provide documentation to verify your identity.
  3. End User agrees that the installation and use of services provided by Revcode will be in accordance with applicable laws governing the monitoring of device, account, application, program activity, usage and will not use services provided by Revcode in violation of any laws the End User is subject to, including any law, rule, ordinance or governmental regulation.
  4. End User agrees to install services provided by Revcode ONLY on devices owned by the End User, or on a device for which the End User has been given explicit permission and/or consent by the device owner for such installation.
  5. End User agrees NOT to install services provided by Revcode on any device not owned by the End User or on any device for which the End User has not been given explicit permission and/or consent for such installation.
  6. End User understands in case services provided by Revcode are installed on a device without permission of the owner, Revcode may open uninstall instructions on the affected system, and as a result, permanently terminate the End User’s service without notice.
  7. End User acknowledges that it is prohibited and against the terms of this EULA not to inform any third party, which device, account, application, or program is monitored by the End User with the Software.
  8. End User acknowledges that support is only provided from the website by means of submitting Support tickets, and that replies may take up to 24 hours.
  9. End User acknowledges the Terms of Service serves is a legal binding contract.
  10. End User understands that all services provided by Revcode with capabilities of remote surveillance are designed and intended for parental control, monitoring of your employees and educational purposes only.
  11. End User understands that scanning any provided executable by Revcode with online virus scanners may result in immediate service suspension while Revcode conducts an investigation to rule out violations of the Terms of Service. Keep in mind that all executable files (.exe) have water-stamps and are easily identifiable.
  12. End User consents not to allow any other person to access the information that the Software collects from the device, account, application, or program, on which the services provided by Revcode are installed other than those allowed from the control panel.
  13. End User understands that the Site and the services provided by Revcode shall be used only with the aim of (i) parental control of their children, (ii) by employers to monitor the devices, which belong to them and on which the employees work, (iii) on a device, which is of a user’s ownership, (iv) by a user with a consent of a device owner.
  14. End User understands that any requests regarding the exchange or swapping of subscription plans will not be accepted, i.e. exchange or swapping from a Windows to an Android service or vice versa.
  15. End User understands that the Terms of Service, Acceptable Use Policy, Privacy Policy and Refund Policy may be updated by Revcode from time to time without notice to you.
  16. End User acknowledges that the physical access to a target device is required for certain services provided by Revcode to be installed on that target device.
  17. End User also consents to the Acceptable Use Policy, Privacy Policy, Acceptable Use Policy and Refund Policy set out by Revcode on this website.
  18. End User acknowledges that the services provided by Revcode may not be installed remotely without possession bona fide of a target device by the End User with physical access hereto.
  19. End User is aware that before installing any services provided by Revcode you have to check the requirements of compatibility of your target device according to the Compatibility Policy. In case you have failed to comply with Compatibility Policy after the installation you agree that it is your responsibility and you may not be refunded.
  20. End User understands that a target device shall be in compliance with the all terms and policies set forth by Revcode on this website to be able to use the Service(s). In case more features are required on a target device a jail-breaking (iOS) or rooting (Android) shall be performed.
  21. End User understands that NO refunds will be issued in cases where your service has been terminated as a result of violation of the Terms of Service.

BY INSTALLING SERVICES PROVIDED BY REVCODE YOU HEREBY WARRANT, REPRESENT, COVENANT AND CERTIFY THE FOLLOWING:

A) Scope of License: The Service Provider grants you a limited, non-exclusive, non-transferable revocable license (hereinafter “the License”) to (i) install the Services on one or more devices, which are owned by you, are under your control, and (ii) view, review and utilize the Services and any related information provided to you by the Services, (iii) or to use the Services for cloud-based monitoring of a specified account, application, or program. Nothing in this EULA should be interpreted as permitting installation of the services provided by Revcode on any device you do not own or control, or which you do not have the legal right to monitor, or to monitor any account, application, or program you do not have the legal right to monitor. It is your responsibility to determine whether you have the legal right to monitor the device, account, application, or program.

B) Services provided by Revcode are Designed and Intended for Legal Use. All Services provided by Revcode are designed for use by those, who have the legal right to monitor the device, account, application, or program, on which it is installed, or which it is used to monitor. The Service provider, Revcode, cannot provide legal advice to you regarding your use of its services. Be aware that it is considered a violation of law almost worldwide in most instances to install or use surveillance software, such as certain services provided by Revcode, to a mobile phone or other device, account, application, or program you do not have the right to monitor. The law generally requires you to notify the Users or owners of the device, account, application, or program that the device, account, application, or program is being monitored. Failure to do so may result in violation of applicable law, which could result in severe monetary and criminal penalties imposed on the violator. You should consult your own legal adviser with respect to legality of using the Licensed Software in the manner you intend to use it prior to downloading, installing, or using the Licensed Software. You take full responsibility for determining that you have the right to monitor the device, account, application, or program on which the Licensed Software is installed. The Service Provider, Revcode, shall not be held responsible if the User chooses to monitor a device, account, application, or program the User does not have the right to monitor.

C) Improper Use of services provided by Revcode. You agree not to use the services in any manner to harass, abuse, stalk, threaten, defame or otherwise infringe or violate the rights of any other person, and that the Service Provider, Revcode, is not in any way responsible for any such use by you, nor for any harassing, threatening, defamatory, offensive or illegal messages or transmissions that you may receive as a result of using services provided by Revcode. In case services provided by Revcode are installed on the device without permission of the owner, the Service Provider, Revcode, has the right to open uninstall instructions for this victim, and make sure that the account of a violator is terminated.

D) License. It is understood and agreed that the Service Provider, Revcode, is the owner of all right, title, and interest in and to the original, and any copies of the Licensed Software and related information, improvements, enhancements or derivatives thereto and ownership of all intellectual property rights pertaining thereto, in whole or in part, shall be, vest with, and remain the exclusive property of the Service Provider. You, as licensee, through your downloading, installing, or use of the services provided by Revcode do not acquire any ownership rights of any services provided by Revcode. The services provided by Revcode are protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The rights granted in this license are limited to the right to download, install, and use services provided by Revcode, and do not include any other intellectual property rights.
You, the End User, agree that you may not and will not: (i) sell, lease, rent, license, sub-license, redistribute, assign or grant the services provided by Revcode; (ii) decompile, disassemble, or reverse engineer the services provided by Revcode, in whole or in part; (iii) write or develop any derivative software, make attempt to derive the source code of, modify, or create derivative works of the services provided by Revcode, any updates, or any part or any other software program based upon the services provided by Revcode; (iv) provide, disclose, divulge or make available to, or permit use of the Software by any third party without The Service Provider, Revcode, prior written consent; or (v) copy the Software.

Any attempt to do so is considered as a violation of the EULA and the rights of the Service Provider, Revcode. If you breach this restriction, you may be subject to legal actions.

The Service Provider ,Revcode, may provide upgrades, modifications, updates, or additions (hereinafter “the Modifications”) to the services provided by Revcode during the term of the License. The terms of this EULA shall be applied to any such Modification unless such Modification is accompanied by a separate license, in which case the terms of that license will be applied.

You represent that participation under this EULA will not breach any agreement to keep in confidence proprietary information acquired by you in confidence or in trust prior to this EULA. You represent that you have not entered into, and will not enter into, any oral or written agreement in conflict herewith.

E) Consent to Refund Policy. You agree to have read and understood the terms set forth in the Refund Policy by purchasing any of the services provided by Revcode.

F) Consent to Use of Data. You agree that the Service Provider, with respect to the Privacy Policy, may collect and use technical data and related information, including but not limited to technical information about your devices, system and application software, and peripherals, that is gathered periodically to facilitate the provision of software updates, product support and other services to you (if any) related to the Licensed Software. You agree that the Service Provider may use this information, as long as it is in a form that does not personally identify you, to improve its products or to provide services or technologies to you. The Service Provider will use data that does personally identify you only in the normal course of business with you directly and will not disclose such data to other parties except as required by courts or agencies of law enforcement or as set forth in the Privacy Policy .

G) Third Party Information. You agree that you will not at any time prior to or after this EULA, improperly use or disclose any proprietary information or trade secrets of any other persons which may be in your possession, if any. Further, should the Service Provider disclose confidential information of its third party licencors, you will comply with any use and confidentiality guidelines requested of you by the Service Provider. You will hold all such confidential and proprietary information in the strictest confidence and will not disclose it to any third party or use it for the benefit of any person other than for the Service Provider or such third party.

H) Services; Third Party Materials. The Licensed Software enables access to third party services and websites (hereinafter – “the Services”). You understand that by using the Services, you may encounter content that may be deemed offensive, indecent, or objectionable, which content may or may not be identified as having explicit language, and that the results of any search or entering of a particular URL by you or by any person in control of the monitored device, account, application, or program may automatically and unintentionally generate links or references to objectionable material. Nevertheless, you agree to use the Services at your sole risk and that the Service Provider shall not be held responsible for the content that may be found to be offensive, indecent, or objectionable.

Certain Services may display, include, or make available content, data, information, applications, or materials from third parties (hereinafter “the Third Party Materials”) or provide links to certain third party websites. By using the Services, you acknowledge and agree that the Service Provider is not responsible for examining or evaluating the content, accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect of such Third Party Materials or websites. The Service Provider does not warrant or endorse, does not assume and will not be held responsible towards you or any other person for any third-party Services, Third Party Materials or websites, or for any other materials, products, or services of third parties.

I) Subscription expiration; You agree and acknowledge that subscriptions that haven’t been renewed within 30 days will be automatically terminated, and a renewal not possible. As a result, related sub-domains (if any), will be terminated as well.

J) You agree that the Service Provider may terminate access to your services, and/or delete all of its associated data at any given time should it come to the Service Provider’s attention that the terms and conditions set forth have been violated. Further, you agree and acknowledge that the Service Provider is the sole beneficiary of its domains and sub-domains used as means of communication for services offered and accessed by the customer, and may be deleted following an account termination.
